Terms and Conditions of Purchase and Subscription

2.1. Object, scope, and acceptance

These Terms and Conditions govern the purchase of products and/or the contracting of subscriptions through fuelti.com (the “Site”), as well as the use of the Site by users. By placing an order or contracting a subscription, you accept these Terms and Conditions. If you do not agree, you should not place orders.

We sell exclusively to consumers for private use. Commercial resale is prohibited without the express authorization of Fuelti.

2.2. Definitions

“Site” or “Web”: fuelti.com and its subpages.
“Customer” or “User”: consumer who browses or purchases on the Site.
“Order”: request to purchase products made through the Site.
“Subscription”: a recurring purchase modality with periodic shipments and recurring charges.
“Product”: the dietary supplement marketed by Fuelti (currently, Fuelti F1).
“Code”: access and/or discount code upon completing a purchase (as indicated on the Website).

2.3. Purchase, account, and private area requirements

You must be of legal age and have the legal capacity to contract.
It is your responsibility to provide truthful and complete information for order management and delivery.
The Site may offer a private area or customer account to manage address, subscriptions, and orders.You are responsible for maintaining the confidentiality of your credentials and all activity conducted from your account.
If you detect or suspect unauthorized use of your account, you must notify us without delay at support@fuelti.com.

2.4. Purchase by Code

The purchase of Products may require the entry of a valid Code during the checkout process. Validity and limits: Codes may be subject to duration, quotas, limitations per person, per order, or by territory, as indicated to the user.

No retroactivity: unless expressly stated, the Code must be entered before completing the order and does not apply retroactively once the purchase is completed.
Misuse: Fuelti may cancel orders or deactivate Codes in case of fraud, resale, technical manipulation, automated use, or any use contrary to good faith.
Technical errors: if the Code does not work due to reasons attributable to Fuelti, the user may contact support to review the case; Fuelti does not guarantee the subsequent application of the Code if the purchase is completed without it, unless expressly agreed.

2.5. Purchase process and formation of the contract

Product information (descriptions, prices, availability) constitutes an invitation to contract and not a binding offer.

By clicking the confirmation button (“order with payment obligation” or equivalent), you make a purchase offer.
You will receive an order receipt confirmation via email. The contract is perfected when Fuelti confirms acceptance of the order (for example, through shipping confirmation) or when the Product is shipped.
Fuelti will provide confirmation of the contract in a durable medium (for example, email).

Availability. All orders are subject to availability. If a Product is not available, we will inform you without delay and we may: (i) offer a new delivery timeframe, (ii) propose a substitute product with similar features (which you can accept or reject), or (iii) cancel the order with a full refund.

2.6. Prices, taxes, and shipping costs

Prices are shown in euros and include VAT, unless expressly stated otherwise.
Shipping costs are displayed before finalizing the order.
If we detect a manifest error in the price or essential information of the Product, we may correct it and offer you the option to confirm the order at the correct price or cancel it with a full refund.
Unless otherwise stated, prices do not include any applicable taxes, duties, or fees outside the EU, which will be the responsibility of the customer, if applicable.

2.7. Payment methods

The available payment methods are displayed at checkout.
We may conduct anti-fraud checks and, if necessary, request additional information or cancel suspicious orders.
We do not store sensitive payment data (for example, full card numbers). Payments may be processed by external providers according to their terms.
Unless expressly stated otherwise, we will not proceed with shipping until we have received full payment.

2.8. Subscriptions

If you subscribe, you will receive the Product periodically according to the frequency indicated at checkout and/or in your customer area.

Renewal: the Subscription automatically renews at the indicated frequency until canceled.
Cancellation: you can cancel at any time with future effect from your customer area or by requesting it at support@fuelti.com.
Cut-off date: to avoid the charge and/or shipping for the next period, cancellation must be made at least five days before the renewal/billing date indicated in your account.
Payment failures: if the recurring payment fails, we may attempt retries and, if it persists, suspend or cancel the Subscription, notifying the customer.
Price changes: we may modify prices with reasonable prior notice (for example, 30 days). If you do not agree, you may cancel before the new price takes effect.

2.9. Delivery

Estimated delivery time: five business days from payment confirmation, unless another timeframe is indicated on the Site.
Delivery is made to the address indicated by the customer. If it is not possible due to reasons attributable to the customer (incorrect address, repeated absence), additional costs may be incurred.
The risk is transferred to the consumer when he or a third party designated by him takes possession of the Product.
Delivery is available within the EU.

2.10. Withdrawal (14 days)

As a consumer, you have the right of withdrawal within 14 calendar days without the need for justification, under the terms provided by the applicable regulations.

2.10.1.Exception for health or hygiene seal

The right of withdrawal may not apply if the seal has been tampered with, for reasons of health or hygiene.

2.10.2. How to exercise the right of withdrawal

Notify us of your decision by email at support@fuelti.com indiincluding your name, order number, and an unequivocal statement of withdrawal.
We will confirm receipt of your request by email.
You must return the goods without undue delay and, in any case, within 14 calendar days following your communication.
The consumer bears the direct cost of the return, unless expressly stated otherwise on the Site.

2.10.3.Effects of withdrawal

We will refund the payments received, including standard delivery costs, without undue delay and, in any case, within 14 calendar days from the date we are informed of the withdrawal. We may withhold the refund until we have received the goods or until you provide proof of their return, whichever condition is met first.

2.11. Returns, incidents, and incorrect product (not withdrawal)

If you receive a damaged, incorrect, or apparently defective Product, contact support@fuelti.com lo as soon as possible indicating the order number and, if applicable, photographs of the condition of the package and the Product. Fuelti may request reasonable information to manage the incident with the carrier or the warehouse. This section does not limit your legal rights as a consumer.

Transport damage: if the package arrives visibly damaged, we recommend indicating this to the carrier when possible and notifying Fuelti.
Incorrect product: if you receive a product different from the one ordered, Fuelti will arrange for the pickup or instruct you on how to proceed, and will send the correct product or refund the amount, as applicable.
Defective product: the legal regime of conformity will apply (see section 3.12).

2.12. Legal warranty of conformity

Fuelti is responsible for the lack of conformity of the product in accordance with the applicable consumer regulations. In general, the business is responsible for the lack of conformity that exists at the time of delivery and is manifested within the legally established period.

For products with a best before date or expiration date, the conformity assessment is carried out according to their nature and the indicated storage conditions. Incidents occurring after the indicated date or resulting from improper storage/handling may be excluded.

2.13. Product: information and warnings

The product is a dietary supplement. It is not a medicine and is not intended to diagnose, treat, cure, or prevent diseases.
Dietary supplements should not be used as a substitute for a varied and balanced diet and a healthy lifestyle.
Respect the recommended daily dose and the storage conditions indicated on the label.
Keep out of reach of children.

2.14. Customer service and complaints

Complaint forms: if applicable, you may request complaint forms in accordance with the applicable regulations.
Online Dispute Resolution (ODR): the European Commission offers an online dispute resolution platform: https://ec.europa.eu/consumers/odr/
Fuelti is not obliged nor committed to participate in alternative dispute resolution procedures before a consumer entity.

2.15.Intellectual and Industrial Property

All content on the Site (texts, brands, logos, images, design, software) is protected by intellectual and industrial property rights. Reproduction or exploitation without authorization is prohibited, except for private use permitted by law.

2.16. Responsibility and Availability of the Site

The Site, services, and information available are provided "as is" and "as available." To the extent permitted by law, Fuelti does not guarantee that the Site will be uninterrupted, secure, or error-free.

None of the above limits non-waivable consumer rights or excludes liabilities that cannot be legally excluded.

2.17. Modifications, partial nullity, and assignment

Fuelti may modify these Terms and Conditions due to legal, technical, or operational changes. In Subscriptions, we will communicate relevant changes with reasonable advance notice.
If any clause is null, the rest will remain in effect.
Fuelti may assign the contract and/or rights and obligations in the context of corporate reorganizations or business transfers, respecting consumer rights.

2.18. Applicable law and jurisdiction

These Terms are governed by Spanish law, without prejudice to mandatory rules of the consumer's country of residence in the EU. For the resolution of disputes, the Courts and Tribunals will be competent in accordance with the applicable regulations on consumers.
